TERMS AND CONDITIONS/Official Rules

1. REDEEMING THE GIFT & ENTERING THE SWEEPSTAKES:
   The Parisian Getaway Gift with Purchase and Sweepstakes Promotion (“Promotion”) begins on Wednesday, October 15, 2025 at 10:00 a.m. (local time – all times set forth in these Terms and Conditions are local time) and ends on Sunday, October 26, 2025 at 6:00 p.m. (“Promotion Period”). Scottsdale Fashion Square is located at 7014 East Camelback Road, Scottsdale, AZ 85251 (the “Center”). During the Promotion Period:

   (i)      Spend at least One Thousand Dollars ($1,000.00) in goods and/or services (excluding Center gift cards) at participating Parisian brand retailers in a single day, and (ii) present the receipt(s) to the Concierge during Center hours to receive one (1) Parisian Restaurant gift card (the “Gift”) and one (1) entry into the Parisian Getaway Sweepstakes.  Participating Parisian retailers include: Hermès, Saint Laurent, Dior, Louis Vuitton, Christian Louboutin, L'Occitane, Maje, Sandro, Lacoste, Cartier, Zadig & Voltaire, Francine, Zinque, Society Swan. All trademarks are property of their respective owners.

   Limit one (1) Gift and up to one (1) Sweepstakes entries per person during the Promotion Period. The Gift will be given away while supplies last. The receipt(s) must be presented to Concierge on the same day as the date of the receipt(s) during the Promotion Period. Once a receipt(s) has been used to obtain the Gift and entry, the receipt(s) will be marked and cannot be used again. The receipts are not transferable. Lost or stolen receipts will not be replaced. No photocopies or duplications of receipts will be accepted or redeemed. Participant will be required to present his/her personal identification with the receipts. Sponsor will maintain a log of participants to confirm limitations. No redemptions or entries shall be made after the expiration of the Promotion Period or after all Gifts have been given away, whichever occurs first. Failure to follow the instructions, procedures, and/or these Terms and Conditions shall render the ability to redeem the Gift and/or Sweepstakes entry invalid.  Participants may also enter the Sweepstakes by requesting and completing an entry form from the Center’s management office during the Promotion Period during office hours. 

2. ELIGIBILITY: Only legal residents of the U.S. who are eighteen (18) years old or older as of the first day of the Promotion Period are eligible to participate. Employees, officers, directors (and their immediate family members and members of their same households) and agents and representatives of (i) the Center, The Macerich Company or Scottsdale Fashion Square LLC (“Sponsor”) or (ii) any of their respective parents, affiliates and subsidiary companies (collectively “Macerich”), and employees, officers, directors, agents and representatives of (A) the merchants of the Center or (B) any advertising or promotion agencies that do business with Macerich are not eligible.

   SWEEPSTAKES: One (1) Grand Prize Winner (“Winner”) will be selected in a random drawing of all entries on October 30, 2025 to receive a round-trip economy class airfare voucher for two (2) from Phoenix, AZ to Paris, France via Air France (the “Prize”).  Approximate Retail Value (ARV): $2,000.  Travel must be completed by June 30, 2026, subject to availability and blackout dates.  International travel requires a valid passport and may be subject to other immigration requirements, e.g., visas.  Sponsor is not responsible for delays or cancellations or other requirements of Air France.  Meals, ground transportation, accommodations, gratuity, personal expenses, and per diem are not included.  Odds of winning depend on the number of eligible entries received.  The Winner must respond within two business days or else may be disqualified and an alternate winner may be selected.

   There is a limit of one (1) prize per person for all sweepstakes, contests, competitions and promotions conducted by the Center in the same calendar year.  No substitution or cash equivalent of the Prize (or portion thereof) is permitted except at the sole discretion of Sponsor, who reserves the right to substitute the Prize (or portion thereof) with one of comparable or greater value. The Prize is nontransferable and is subject to the terms included therein.  Each winner agrees to accept his or her Prize “as is.”  A lost or stolen Prize will not be replaced. All trademarks are property of their respective owners.

3. THE GIFT: The Gift is subject to availability. The Gift has no cash value. No substitutions or exchanges. Sponsor is not responsible for lost or stolen Gifts. The participants agree to accept the Gift “AS IS.”
4. GENERAL CONDITIONS: Each participant is solely responsible for all taxes as it relates to their respective Gift or Sweepstakes prize, including applicable sales and income taxes. Once redeemed, receipts become the property of Sponsor and will not be returned.

   Except where prohibited by law, by accepting the Gift or entering the Sweepstakes, each participant grants Sponsor, Macerich, and each of their respective partners, licensees, parents, subsidiaries, affiliates, assigns, related companies and successors, and all of their respective officers, directors, employees, representatives, attorneys and agents (collectively, “Sponsor Entities”) the universal and perpetual right and license to use, exploit, print, publish, reproduce, display, distribute and broadcast and to grant others the right and license to use, exploit, print, publish, reproduce, display, distribute and broadcast the participant’s name, actual or simulated likeness, photograph, image, voice, portrait, picture, personal characteristics, biographical information and other personal identification in any and all languages, formats, and media now known and hereafter developed (including, without limitation, on Facebook, YouTube, Twitter and Instagram), in connection with promotion of the Sponsor Entities, Center’s website, the Promotion and/or any Promotion related activity and any and all advertising, promotion, marketing, and/or publicity thereof, including all ancillary and subsidiary rights therein, without additional consideration.

   Sponsor reserves the right to disqualify any person tampering with the redemption or entry process, presenting duplicate or photocopied receipts, or otherwise in violation of these Terms and Conditions.  Such a person may be prosecuted to the fullest extent of the law. Sponsor further reserves the right to cancel, terminate, suspend or modify this Promotion if not capable of completion as planned due to causes beyond the control of Sponsor.

5. TERMS AND CONDITIONS: This Promotion is subject to these Terms and Conditions which will be available at Concierge at the Center during the Promotion Period. By participating in the Promotion, participants agree to waive any right to claim any ambiguity or error in these Terms and Conditions or the Promotion itself and agree to be bound by these Terms and Conditions and by all decisions of the Sponsor, whose decision is binding and final in all respects.
6. DISCLAIMERS: Sponsor Entities are not responsible for lost, late, damaged, incomplete, stolen, illegible, misdirected, deleted, destroyed or altered receipts or entries; or for any mail, computer, telephone, cable, network, electronic or Internet hardware or software malfunctions, failures, errors, interruptions, deletions, defects, delays, connections, availability or garbled or jumbled transmissions, service provider/Internet/Web Site/use net accessibility or availability, traffic congestion, or unauthorized human intervention.  Sponsor Entities are not responsible for any incorrect or inaccurate information.
7. RELEASE: By participating, participants on behalf of themselves and their heirs, executors, administrators, successors and assigns hereby knowingly and voluntarily release, discharge, waive and relinquish, and agree that they will not assert or maintain against the Sponsor Entities and those involved in the development, production, implementation and distribution of this Promotion, all participating merchants and their designated agents and any other person or entity associated with such entities and/or this Promotion, and any of their respective officers, directors, employees, representatives, attorneys, or agents (collectively, “Sponsors’ Companies”), any claim, action, suit or demand of any kind or nature whatsoever, whether known or unknown now or in the future, directly or indirectly, in whole or in part, arising out of or in connection with their participation in this Promotion, redemption, or their acceptance, possession, use or misuse of the Gift or Sweepstakes prize in any way (including any tax liabilities).  Entrants hereby acknowledge that they may hereafter discover facts different from or in addition to those which they now know or believe to be true and agree that this release will remain effective notwithstanding.  The Winner shall be required to execute reasonable documentation before receiving the Prize, including eligibility affidavit, release, and tax-related documentation.  If the Winner refuses to execute such documentation within five (5) business days, they may be disqualified and an alternative winner selected.  An IRS Form 1099 reporting the value of the Prize as earned income will be issued as appropriate. 
8. WINNERS LIST/RULES:  The name of the winner may be obtained after November 1, 2025, by sending a self-addressed, stamped envelope, to be received before November 30, 2025, to: SFS Parisian Promo - Winner, c/o Scottsdale Fashion Square, 7014 E Camelback Road, Scottsdale, AZ 85251, Attn: Marketing Manager.

9. GOVERNING LAW: Except to the extent pre-empted by federal or other applicable state law, this Promotion shall be governed by the laws of the State of Arizona (without giving effect to any conflict of law provisions thereof). By participating, participants agree that any and all disputes which cannot be resolved between participant and Sponsor, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively, before a court located in the City of Scottsdale, State of Arizona, which Court shall apply the laws of the State of Arizona.
